Terms & Conditions

These terms and conditions govern your use of AssureUX's website and services. By submitting a booking request or engaging our services, you agree to these terms.

1. Services

AssureUX provides human-driven website testing and related consultancy services as described on our website. The exact details of each engagement may differ slightly from the stated 'packages' and this is confirmed at the point of booking.

2. Payment Terms

A deposit of 20% of the agreed fee is required to confirm your project slot and begin work. The deposit is non-refundable except where the Find-or-Refund Guarantee in section 3 applies. The remaining 80% is invoiced upon delivery of your final report. Payment is due within 14 days of the invoice date. If an invoice is not paid on time, AssureUX reserves the right to take legal action unless a resolution is made between the parties. Other than under section 3, refunds are only given where we agree otherwise in writing.

We accept bank transfer and other payment methods as agreed at time of booking. All prices are stated in British Pounds (GBP) and are exclusive of VAT where applicable.

3. Find-or-Refund Guarantee

This guarantee applies to the Essential Audit, Advanced Review and Ultimate UX packages, for websites of three or more public pages. It does not apply to the Quick Scan.

If the final report contains fewer than 10 issues, or fewer than 3 issues rated moderate or critical, you may request a full refund of all fees paid, including the deposit, by emailing contact@assureux.co.uk within 14 days of the report being delivered.

The guarantee applies only where the access and information we asked for were provided, and where the scope was not changed by agreement. It relates only to the number and severity of issues in the report. It is not a guarantee of any business outcome, including traffic, conversions or sales, and it does not extend the limitation of liability in section 7.

4. Delivery

Estimated turnaround times are provided as a guide only and may vary depending on project complexity and current workload. We will communicate any delays promptly. Time is not of the essence unless explicitly agreed in writing.

5. Client Responsibilities

You agree to provide accurate information about your website and requirements. You confirm that you have the legal authority to request testing of the website(s) submitted. AssureUX accepts no liability for any testing conducted on websites you do not have permission to test.

6. Intellectual Property

Upon receipt of final payment, the deliverable report and its contents become your property. AssureUX retains the right to describe the nature of the work (but not its specific findings) in our portfolio or marketing materials unless you request otherwise in writing.

7. Limitation of Liability

Our liability to you in connection with any project is limited to the total fees paid for that project. We are not liable for any indirect, consequential, or special losses arising from the use of our reports or recommendations.

8. Confidentiality

We treat all information you share with us as confidential and will not disclose it to third parties without your consent, except where required by law.

9. Cancellation

You may cancel a project at any time. If work has already begun, the deposit is non-refundable (except under section 3) and any work completed to the cancellation date may be invoiced at a pro-rata rate.

AssureUX reserves the right to terminate work at any time with good reason such as the client becoming abusive or non-responsive.

10. Governing Law

These terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.

11. Changes to These Terms

We may update these terms from time to time. The version in force at the time of your booking will govern that engagement.
